This Privacy Policy sets out how we, Bendon Limited, as the data controller, (we, us or our) use your personal information or personal data (information) to help us provide you with great products and services, run our business and comply with our obligations at law.  We will take all reasonable precautions to ensure the information you provide or share with us is treated responsibly, ethically and securely.

  • Communications: Details of your interactions with us, including any queries, complaints or comments you make or reviews you give.  
  • Preferences:  Details about your favourite products and brands, where and how   you shop and what your interests are.  
  • Website information:  Details of how you use our website, including technical information about how you connect to and use our website, what pages you visit, and the location where your device is located.
  • Cookie information:  Information that gets collected by cookies, as set out below in the cookies section.
  • Financial information: Payment card details.
  • Login details:  Where you have an account with us, your user name and password.  
  • Social media:  Your social media account details if you choose to interact with us through social media.


You are not obliged to share any information with us, although if you elect not to then that may impact how we can interact with you and you may be unable to access certain information, products or services.

How do we collect your information? 
We collect information about you in different ways, such as when you make a purchase with us, whether online or through our website;

  • visit our website;
  •  visit our stores (through CCTV);
  • create an account with us;
  • contact or interact with us through any of our communication channels, including emails, our website, chatbot   or through social media;
  • complete any surveys   we send you;
  • review or comment on our products and services; or
  • authorise a third party to share information with us .

We may also collect information that is publicly available.   


How do we use your information? 
We collect and use information to help us provide you with great products and services and to help us run our business, including:
To fulfil our contractual  obligations 


We will collect and use your information to fulfil our contractual obligations.  For example, we may use your information to:

  • Process your orders and payments.
  • Respond to any questions or complaints that you might have or to issue refunds.
  • This also requires us to keep records of orders and communications with you.  
  • Keep you updated about your order.
  • Track delivery orders so that you can see when they should arrive.  


With your consent  
In certain circumstances, we may collect your information with your consent or where you have authorised us to do so.   You have the right to withdraw your consent at any time.

 
To comply with law
We collect, use and share information to comply with law.  For example, we might need to collect, use and share information to:

  • Protect our business and property.
  •  Comply with our tax and financial reporting obligations.
  • Assist with investigations or prosecutions of fraud or criminal or other illegal activity.

To pursue our legitimate interests
We will collect and use information to help us run our business.  Where we do so, we will ensure that those uses don't override your interests, fundamental rights and interests.  For example, we might use your information to:

  • Send you emails where   you have left an item in your cart on our website.
  • Where you have asked us to, send you an email notifying you of an item that is back in stock.
  • Promote products, events, sales and competitions that we think might be of interest to you, including products, events , sales and competitions offered by our partners.   Customers who do not wish to have   their personal information used for marketing purposes are welcome to indicate that desire to us at any time. E-mails sent to you will contain an opportunity to be removed from future e-mails.
  • Undertake competitions and administer prizes.  
  • Operate our loyalty programme.
  • Help us improve our business, including research and product development, assessing and monitoring trends and how our website and stores are used.
  •  Interact with you about our business and services.  For example, when we update this Privacy Policy we may notify you of that by email.  We may also need to communicate with you where you send us a question or want to return a product.  We will also keep records of our interactions with you, including complaints or refund requests so that we can communicate with you helpfully and as efficiently as possible.
  •  Help us protect our business, property and staff from illegal behaviour or fraud, including through the use of CCTV.  
  • Maintain your account and the operations of our website, including to protect the integrity and security of our website and to enforce our Terms of Service.
  • Monitor and assess how effective our marketing and advertising is.  
  • Maintain records to comply with our tax, accounting and financial reporting obligations.

  • How is your information shared ?
    There may be cases  in which some of your personal information may be shared with third parties who assist us in our business or provide a service to users connected with our business such as postal service providers.
    We may use or disclose your personal information to organisations outside Bendon Limited (including organisations outside New Zealand and Australia) for the purposes set out above in the "How do we use your information?" section  .  Such organisations include:
  • service providers that manage or help us provide services and products;
  • payment providers;
  • our related companies;
  •  mailing systems which organise delivery of the products you have purchased;
  • market research companies;
  • marketing, data and advertising providers. For example, we may need to share information with Google Analytics or Meta.  We use cookies to do this and you can opt-out of this through Google or Meta  ;
  •  technology companies who help us provide our website and business systems;
  •  law enforcement agencies, such as the police; and
  • our professional advisers, accountants, lawyers, auditors.


We require these organisations to adhere to confidentiality obligations about your information, to use the information for only the relevant purposes, and we seek to ensure that they adhere to legal requirements.


In the event that we contract with a third party to provide some part of the information or service that you have requested, we may provide your information to such third party, or such third party may collect information from you, on our behalf.


We may otherwise use or disclose your information with your consent (or if we have given you notification of the intended use or disclosure and you have not objected to that use or disclosure) or where required or permitted

  • Emergency situations and assisting law enforcement agencies.

  • Where we believe that the use or disclosure is reasonably necessary to enforce any legal rights we may have, or is reasonably necessary to protect the rights, property and safety of us, our customers, or others.


How long do we keep your information for?
We keep information for as long as needed for us to use that information for the purposes set out in the "How do we use your information" section above.    We may retain your information for a longer period if we think that there is likely to be a complaint or legal action in relation to that information.


To determine the appropriate retention period, we consider the amount, nature and sensitivity of the information, the potential risk of harm from unauthorised use or disclosure of your information, the purposes for which we process your information, and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.


How we use Cookies
Most websites, including ours, use Cookies to personalise your online experience and deliver content specific to your interests. A Cookie is a small data file that we write to your hard drive when you visit any of our sites. It can contain information such as your user name and how often you visit our site(s) each month. The only personal information a Cookie contains is the information you provide yourself (excluding passwords and sensitive financial details). Credit Card Information Security Policy

Bendon Limited uses Shopify Payments for secure online credit card transactions. Shopify Payments is designed with industry-leading security practices to protect customer payment information.

 

Key Security Features:

  • PCI Compliance: All Shopify stores are PCI-compliant by default, meeting the highest standards for payment card data security 
  • Data Encryption: Sensitive payment information is encrypted and securely processed 
  • Fraud Protection: Advanced fraud detection and analysis provides risk assessments on every order 
  • 3D Secure: Additional authentication layer for enhanced transaction security 
  •  Limited Access: Bendon Limited does not have access to full credit card numbers - payment data is securely handled by Shopify's payment infrastructure.
  • SOC Compliance: Shopify undergoes SOC 1 and SOC 2 compliance audits every 6 months with independent evaluations

Payment Processing:

  • Payments are processed in real-time through Shopify's secure payment gateway • Customer payment data is protected through multiple layers of security controls • All transactions are monitored for suspicious activity


 Securing and Storing your information
Information is stored electronically on our computer system. We use a variety of security measures to maintain the safety and integrity of the information.
We are committed to maintaining the confidentiality of the information that you provide us and we will take all reasonable precautions to protect your information from unauthorized use or alteration.


Online Security
Firewalls, anti-virus software and e-mail filters, as well as passwords, protect all our electronic information. All user contact information is contained behind a "firewall" and only accessible by a limited number of employees who have special access rights to production systems.
If you choose to modify your personal information you may visit the My Account page you will be required to submit a valid e-mail address and password for authentication before you will be able to modify your file. If you have forgotten your password you will need to visit the Login/Register page and follow ‘Forgot your password’. You will be promoted to enter your e-mail address and a Reset Password e-mail will be sent. If you desire to change your password, and have forgotten your e-mail address, please call our customer service team and they will help transfer your account once you have properly identified yourself.


General Privacy Information
Our website may contain links to websites of partners, advertisers and third parties. Those sites may collect personal information under the terms of their privacy policies independent of us. We have no responsibility for the content or operation of those websites and we are not responsible for matters arising from their use.
While we strive to protect your personal information, we cannot warrant the security of information you transmit to us, and you do so at your own risk. You are solely responsible for maintaining the secrecy of your password and/or any account information.

Your rights 
You can  access or correct any personal information we hold about you.  To do so, please contact us through the details below, and provide as much detail as possible about the particular information you seek, so we can retrieve it. We rely on you to advise us of any changes or updates to the information we hold.
In addition depending on where you are located, which country's laws apply, and the particular circumstances you may be able to:  

  • request the deletion of your information, e.g. where you have withdrawn your consent to our use of it.
  • ask to receive a copy of the information you have provided to us, or for that to be shared with a third party.
  • require us to restrict or stop our use of your information.
  • object to the use of your information.
    In addition, when you've given consent to use your information, you can withdraw that consent at any time.  Where you make a request to exercise any of your rights under this Privacy Policy, we may need to verify your identity to be able to action your request.


Changes to our Privacy Policy
We aim to ensure that our privacy policy continually meets all legal requirements applicable to us in order to maintain and honour your privacy.
From time to time it may be necessary for us to revise this Privacy Policy. We may notify you about changes to this Privacy Policy by posting an updated version on our website or, where the change is significant, we’ll notify you of any important changes via   email.
